The present rules of socialization, terms and conditions are a guideline of coexistence so that LAV residents can interact in harmony and tranquility for the well-being of all.

Los Arroyos Verdes is known for offering an environment conducive to physical, mental and spiritual relaxation. The next policies and procedures are designed for the security, safety and enjoyment of all of our guests.

1. GENERAL INFORMATION

A) The common areas are for the exclusive use of residents who are up to date with their rent, bar bills, laundry and fines. The owners who have their units sublet will not be able to use the facilities, having transferred the rights to their tenants.

B) Neither the Administration nor staff are responsible for accidents that occur in the common areas of LAV due to carelessness, negligence and / or irresponsibility of guests.

C) The tenant is responsible for all damages caused to the common area as well as civil and / or criminal and / or administrative and / or labor liability related to any accident, damage or injury that any of their guests may suffer; to the common areas, as well as to third parties, forcing themselves to remove in peace and safe from any controversy the development, the neighbors, the Administration and the operations team.

D) In all cases, the lessee must bear the cost of repairing the damage, in addition to the fine established in the “Sanctions” chapter.

E) The administration and / or staff will have the power to suspend the electricity of any common area if the tenant does not comply with the hours, decibels allowed or if he is not complying with the socialization norms or the condominium regulations.

F) The chapters described in these socialization norms invalidate any other previous document that refers to them.

2. CHECK-IN/CHECK-OUT

Check-in time is 3:00 pm on the day the tenant’s scheduled reservation begins. Early or Later arrivals must be arranged in advance though an email or phone call.

Check-out time is 11:00 am on the day the tenants scheduled reservation ends. We understand international flight times vary; you can arrange to store bags and belongings prior to check-in and/or after check-out.

3. RATES

Room rates are quoted per night per house or loft. Rates are quoted per night excluding tax (16%) and are subject to change without notice. We make every effort to honor specific villa requests. If we must reassign a house selection for any reason, we guarantee that you will receive an equal or upgraded room type and equal amenities and services. Rates as published on Los Arroyos Verdes’ website are guaranteed.

Walk-in guests are welcome but depends on availability.

4. DEPOSIT & PAYMENT

For Reservations of 5 days to 1 month, 100% of total payment is due at the time reservation is made.  For Reservations of 2 to 5 months and for long-term Reservations of 6 months to 1 year, the payment will be for the total of two months, one month for deposit and one for the first month of stay. Payments can be made through PayPal, (+ 4.5% additional fee), bank deposit, wire transfer or personal check.4.

For 2 months to one-year reservations, at the end of your contract:

In the case you are not renewing your contract the rent deposit cannot be used to pay the last month of rent. Rent deposit will be returned during the first 1 to 30 days after the expiration of the contract.

5. CANCELLATIONS

A last-minute cancellation gives us little chance of re-booking a house or loft. For this reason our cancellation policy is applied, with no exceptions, including sickness, family emergencies, or weather-related issues. Reserving accommodations creates a legally binding contract, whether you reserve verbally, in writing or online. By accepting your reservation, we agree to hold a house of equal or greater value for you on the dates requested and to turn down other requests for the same accommodation on those dates you have reserved. By accepting the reservation, future tenants are responsible for payment of all nights reserved regardless of their actual arrival or departure date. No Shows will be charged the entire cost of the reservation. Date change requests are subject to availability.

Cancellation:

  • Up to 120 days prior to your arrival, 100% of your initial payment is refunded.
  • Cancelations between 119 and 90 days prior to your arrival, 60% of your initial payment is refunded.
  • Cancelations between 89 and 60 days prior to your arrival, 40% of your initial payment is refunded.
  • Cancelations 59 days or less prior to your arrival, 0% of your initial payment is refunded.

6. REFUNDS

There will be no refunds for early departures (fewer days than reserved). No refunds will be given for delayed arrival. No refunds for reducing the number of nights reserved. Refund requests will be processed within 30 days from the time of the request.

We make every effort to honor specific house requests. If we must reassign a room selection for any reason, we guarantee that you will receive an equal or upgraded room type and equal amenities and services. Rates as published on Los Arroyos Verdes website are guaranteed.

Walk-in guests are welcome if there are houses or lofts available.

7. ACTS OF GOD

The Owner shall not be liable for events beyond their control which may interfere with future tenants occupancy, including but not limited to Acts of God, acts of governmental agencies, fire, strikes, war, weather, epidemics or pandemics. No rebate or refund will be offered in these circumstances, and are subject to our CANCELLATION POLICY described below.

8. OWNER’S RIGHTS

Los Arroyos Verdes is privately owned and operated. The owners reserve the right to refuse service to anyone. We will not be responsible for guest accidents or injury, or for the loss of money, jewelry, or valuables of any kind.

9. PROPERTY ISSUES

Any damages, stolen items, or broken items occurring during the stay will be the full financial responsibility of the tenant, including anyone traveling with the tenant. Any special clean-up resulting in damages caused by the guests will also be charged to the tenant.

Charges may need to be applied at the time of tenant departure as deemed necessary by the owner or administration.

Please report all spills and/or damages to the owner or administration promptly.

10. ACCESSIBILITY

At Los Arroyos Verdes we have villas and areas that are wheelchair-accessible.

11. TECHNOLOGY

LAV has limited complementary internet. As it is complementary, we are not responsible for interruptions of this service, including: supplier maintenance, weather conditions or incompatibility with your electronic devices. The WIFI code can be found printed and pasted on the bag of controls that were delivered when arriving below the cover. The internet in public areas is in the pool in the bar area.

The service is free and is thought to answer emails but not to broadcast Netflix or similar.

12. TV

We do not offer cable service, you can request the service of your choice on your own. We have a cable TV provider. The cost is $ 500.00 pesos per month and they ask for a guarantee deposit of $ 1,000 pesos at the time of requesting the service. Be aware that rates might change without further notice.

13. ENTERTAINMENT, BOARD GAMES AND BALLS

In the office we have board games, soccer and basketball balls, tennis rackets and balls, among others; you can also use them. They are for everyone who live in LAV, please return them the same day.

14. MULTIPLE USE COURTS

A) The hours for the use of the multiple courts is from Monday to Sunday from 6:00 a.m. until sunset.B) The keys to the court are in the office.C) You will have to wear sportswear, tennis and it will be forbidden to play with a naked torso.D) Within the multipurpose pitches, it is strictly forbidden:• Introduce glass containers or containers• Enter with skates, skateboards, bicycles, tricycles, or other objects that can damage them. Hitting walls, floors, and structures.• Use obscene words and yelling.• Entering with alcoholic breath, intoxicated or intoxicated by any substance.• Ingest alcoholic beverages, consume food and / or smoke.• Access with pets.• The tenant may enter with a maximum of 3 guests to the multipurpose court, which must be accompanied by the tenant at all times.

15. SMOKING

Smoking is not allowed inside the houses. It is allowed outdoors only in designated areas, only on the elevated side of the pool. Smoking is allowed on the terraces of their respective houses, as long as they do not disturb the neighbors. Tenants caught smoking in the house will be charged and damage caused by cigarettes, cigars, pipes or other devices will be charged for the full value of the damaged item plus corresponding deep cleanings to remove the odor from the furniture. Additional cleaning costs, including loss of income due to room closure for additional cleaning, will be charged to the tenant. Therefore, only smoke in designated outdoor areas.

16. ILLEGAL SUBSTANCES

Each and every illegal substance is not allowed. Violation of this policy will result in the proper authorities being notified, guests being asked to leave the property, and the loss of all money owed for the reservation.

17. ADDITIONAL GUESTS

Our priority is the comfort, privacy and security of our residents. Each accommodation has a maximum capacity. If you would like to have an extra guest overnight in the accommodation the charge is $450 pesos per person per night.

The tenant may enter with a maximum of 4 guests from Monday to Sunday in the event that their house has two bedrooms and 2 guests if they live in a loft or one-bedroom house. From the 5th or 3rd guest there will be a charge of $ 300.00 pesos for the use of the pool, with a maximum of 15 guests in total.

Guests rooms cannot be transferred to another party without advance notification and permission from the Los arroyos Verdes owners / administration.

Any reservation made under false pretenses will result in loss of advance payments and possible removal of guest from the villa.

Guests shall be entitled to the quiet enjoyment of Los Arroyos Verdes. Any disturbance resulting in police action, neighborhood complaints or any violation of the rules and regulations is considered sufficient cause for immediate termination of your stay with all monies paid forfeited

18. CHILDREN

All children under 18 must be supervised by a parent or another adult at all times, whether staying overnight or as a guest. Children must behave in a way as to not disturb the other guests and residents.

Injuries to children and damages to Los Arroyos Verdes or other guests are the complete responsibility of the parent or adult.

We don’t have high chairs, portable cribs, toys or children’s menus. There are local companies which rent items such as beds, chairs and toys for children and we would be more than happy to recommend these services during your stay.

19. PETS

We are a pet-friendly development. We love animals, for that reason we ask that when out for a walk, your pets are on a leash all the times. They can be with you by the pool on leash but, they’re not allowed in the pool.

We have a relief area with a small fountain for them; please pick up after your dog.

Only one large dog, two small dogs or two cats are allowed per house. It is important that the dogs behave and stay at home, to prevent them from barking and disturbing the neighbors. Staying at home means that the dogs sleep indoors at night.

 

If you don’t clean after your dog we charge a fine of $2,000 pesos

20. QUIET HOURS

Quiet hours are from 11pm–8am. If you are coming in late or rising early, please be considerate of your fellow neighbors.

21. LAUNDRY SERVICE

We have a self-service laundromat. The opening hours are from 09.00am to 5.00pm from Monday to Friday and Saturdays from 09.00am to 1.00pm. The service can be requested at the Office.  The fee is $50 pesos per load each on dryers or washing machines.

22. DAMAGES

Residents are responsible for any damages they cause. Damage or excess cleaning needed after a residents’ departure need to be covered at the time of the checkout. This includes damage to furnishings, fixtures, linens or towels that result in the need for excess cleaning, repair or replacement. Please notify the administration immediately if you experience any issues with your accommodations.

23. POOL

A) The pool is open from 9 a.m. at 10 p.m. The towels for the pool are found in each of the houses that hired the white linen service. Towels can be recognized by being stipped.

B) Children are not allowed in or around the pool without adult supervision. We are not responsible for any accidents or injuries to guests.

C) Appropriate and respectful conduct must be observed in the restrooms and pool.

D) The tenant may enter with a maximum of 4 guests from Monday to Sunday in the event that their house has two bedrooms and 2 guests if they live in a loft or one-bedroom house. From the 5th or 3rd guest there will be a charge of $ 300.00 pesos for the use of the pool, with a maximum of 15 guests in total.

E) Children’s classes with their respective teachers may be held at the same pool opening hours, always leaving an area for residents who are not taking classes.

F) Classes may be taught exclusively to residents of LAV

G) It is only allowed to enter the pool with a bathing suit, and it is strictly forbidden to use street clothes.

H) Babies must wear a special diaper for swimming.

I) Within the pool area, it is strictly prohibited:

  • Enter with skates, skateboards, bicycles, tricycles or other objects that could damage them.
  • Use obscene words and yelling.
  • We do not allow the use of glass containers in the pool.
  • Outside alcoholic beverages or food are not allowed during bar hours.
  • Spitting into the pool, cleaning the nose, urinating and any other action that damages the facilities and users.
  • Music (only allowed with headphones).
  • Children under 12 must be accompanied by an adult at all time. The parents are responsible and exempt the development from all responsibilities.

24. GYM

A) Residents may use the gym equipment and apparatus within the following hours: Monday through Sunday, from 6:00 am to 11:00 pm.

B) If you wish to use the air conditioning, you must request the remote at the office, please return it at the end of your routine.

C) There will be a time limit of use per machine of 30 minutes when there is a condominium owner waiting and they may continue to do so indefinitely, as long as there are no residents waiting.

D) The tenant may enter the gym with a guest, who must be accompanied by the tenant at all times.

E) To use the facilities, users must do so with tennis shoes and appropriate clothing for sports.

F) The equipment within the gym must be taken care of as much as possible. It is the user’s obligation to turn off the equipment after use. All used weight equipment must be returned to its place after use; It is mandatory to return the dumbbells, remove the discs from the bars, and place the bars and discs in their places.

G) The entry of children under 14 years of age is prohibited. Babies will be allowed access in their stroller (under the absolute responsibility of the parents – check chapter of – and, in case the babies cry, they will not be able to stay inside the gym.

H) Users are obliged to clean the devices when they have finished using them.

I) Any person who uses the facilities will do so at their own risk and subject to the corresponding regulations and instructions. The administration and the committees are not responsible in any way for any eventuality, accident, injury, etc. that could be suffered by people who use the gym facilities.

J) In the gym area it is strictly forbidden:

  • Introduce glass containers or containers
  • Enter with skates, skateboards, bicycles, tricycles, or other objects that can damage them.
  • Hitting walls, floors, and structures.
  • Use obscene words and yelling.
  • Entering with alcoholic breath, intoxicated or intoxicated by any substance.

25. SPA

We can contact you with a professional therapist in case you require any SPA treatments. We have the SPA menu in the office.

26. BOTTLED WATER

We deliver jugs of water to homes every business day, that is, from Monday to Saturday, at 12:30 pm, please order them at any time before 12:30 pm to be delivered the same day. After 12:30 pm, they will be delivered the next day. The cost is $ 50 pesos.

In case you are not at home, the jug will be left at the entrance.

27. LAUNDRY

We have a self-service laundry, the hours are from 09.00am to 5.00pm from Monday to Friday and Saturdays from 09.00am to 1:00 pm. You can request the services during office hours. The cost is $ 50.00 pesos per load, either washed or dried.

We invite everyone to maintain order in outdoor patios and terraces. Avoid hanging clothes on parapets, windows, chairs, tables, railings and terraces. Drying clothes is only allowed on folding clotheslines, as less visible as possible so as not to affect the image of the development.

28. TRASH

We are a development in favor of caring for the environment, that is why we separate glass, cans and plastic bottles in the large wire jars that are found at different points in the development.

The common garbage is deposited in the plastic garbage cans that are marked and in different areas of LAV, it is removed every other day.

It is important to deposit all household waste in closed garbage bags. The diapers please deposit them in a double closed garbage bag, this to avoid odors.

Batteries can be left at the office.

29. ELECTRICITY

For all guests of Los Arroyos Verdes, please keep the use of the A/C only when you are in your Loft, Villa or Casita. For leaving the Air Condition unattended for more than 24hrs we will apply a $3,000 pesos fine.

For stays from one month onwards, electricity consumption will be charged separately. This is why each house has an independent electricity meter. The cost of electricity is according to what the federal electricity commission states.

30. VISITORS

It is important that visitors are announced at the gate to let them in and not make them wait. Parking inside LAV is for residents only. This is why all visitors have to park outside.

31. SUBLEASE

Sublease will be only authorized by the administration. Once it’s been approved there’s going to be a $1,000 pesos charge for each check-in and $1,000 pesos for check-out, these have to paid in advance or during the time of the original lease.

The primary renter will be responsible for giving all the information (dates of cleaning, internet, tv, towels) and for any damages as well that may occur on the property during that time. Also, a copy of renter´s Id will take by the administration.

32. OTHERS

All requests (water, laundry or something unforeseen in your home) must be made in the office, where your request will be scheduled. Avoid requesting it from the cleaning, exterior and maintenance teams.

Remember that all payments, both rent and other services have to be in the administrative office. Avoid giving money to staff, unless is tips.

A tenancy (lease) agreement is a legally binding contract . If it is broken, compensation may need to be paid. Deposit will be not returned and other fees may apply.

If a tenant ends a fixed term agreement before the end date, this is considered breaking the agreement. Otherwise known as breaking the lease.

Any agreement should be put in writing and read carefully for a full understanding.

33. SANCTIONS

Definition of sanction: Fine or measure of constraint imposed on the tenant and tenant that violates the regulations.

When a tenant or tenant incurs a breach of the Internal Regulations or socialization norms, a fine of $ 2,000 per event will be applied to all violations that are not previously classified and, depending on the severity, the administration will be empowered to apply a penalty of up to $ 10,000 pesos per event.

In parallel, the tenant or tenant will be exhorted to comply with the regulations, without prejudice to the sanction imposed, being the administrator who presents said letter and it will be reflected in the corresponding registry.

In the event of a repeat offense, the fine will be multiplied by two for each occasion that it occurs. Regardless of the sanction (s), the tenant or lessee will be responsible for the cost of repair or replacement of the damages that, if applicable, they may have caused.

The fines must be paid no later than the 10th of the current month or the following month as the case may be, otherwise the administration will be empowered to close the services paid through the maintenance fees in case the payment is not made. in the stipulated time. Being able to pay it to the account of the condominium by transfer, at the window or with a credit or debit card directly in the administration of the condominium with the additional charge of the commission that the bank is charging at the time the charge is made.
